These Terms of Service govern your use of this website and your purchase of products from Field Works & Utility. By accessing this website or placing an order, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy, and Return and Refund Policy.
If you do not agree with these terms, please do not use the website or place an order.
1. About Field Works & Utility
Field Works & Utility designs and sells high-visibility load-bearing field systems, frames, components, and related products for outdoor field professionals.
Our products are intended to support field carry, organization, and visibility in demanding outdoor work environments. They do not eliminate workplace hazards or replace site-specific safety procedures, employer requirements, training, or judgment.
2. Eligibility to Purchase
You must be the age of majority in your province, state, or territory of residence, or have the consent of a parent or legal guardian, to place an order through this website.
By placing an order, you confirm that the information you provide is accurate and that you are authorized to use the payment method provided.
3. Product Information
We make reasonable efforts to describe and display our products accurately. However, product images, colours, materials, dimensions, components, specifications, and packaging may vary from what appears on the website.
This is especially true for pre-order products, prototypes, samples, first production runs, or products shown in development imagery.
Field Works & Utility may update product specifications, materials, components, or designs where necessary to improve performance, manufacturing, compliance, durability, or availability.
4. High-Visibility, ANSI, CSA, and Workplace Compliance
Where a product is described as high-visibility, ANSI, CSA, or otherwise compliant with a standard, that description applies only to the specific product configuration stated.
Compliance may be affected by:

modification;

improper use;
-
improper care or washing;
-
damage;
-
contamination;
-
worn materials;
-
use with non-Field components;
-
covering or obscuring reflective or high-visibility materials; or
-
use outside the conditions for which the product was designed.
Customers are responsible for determining whether a product is suitable for their workplace, employer, site conditions, and applicable safety requirements.
Field products are designed to support field carry and visibility. They are not a substitute for hazard assessment, proper training, safe work procedures, or employer-approved personal protective equipment.
5. Orders
Placing an order through the website does not guarantee acceptance of the order.
Field Works & Utility may cancel, refuse, or refund an order where there is an issue with:

product availability;

pricing;

product information;
-
payment processing;
-
suspected fraud;
-
incorrect customer information;
-
shipping limitations;
-
website or checkout errors; or
-
any other issue that reasonably affects our ability to fulfill the order.
If we cancel an order after payment has been collected, we will refund the amount paid to the original payment method, unless otherwise required.
6. Pre-Orders
Some products may be offered for pre-order.
By placing a pre-order, you reserve your item from Field’s first production run. You pay today, but may cancel for a full refund until production begins. Before production begins, we will contact you to confirm that you still wish to proceed. After production begins, your order is locked in and will ship once manufacturing is complete.
Estimated production and shipping timelines are estimates only. They may change due to manufacturing schedules, material availability, supplier delays, freight delays, customs delays, quality control, compliance review, or other factors outside our control.
If a pre-order product is materially changed before production begins, we may contact you with updated information and, where appropriate, provide an opportunity to cancel before production proceeds.
7. Pricing, Taxes, and Fees
Applicable taxes, shipping charges, duties, and other charges will be shown where available before checkout is completed.
Customers are responsible for any taxes, duties, import fees, customs charges, brokerage fees, or other charges that may apply to their order, unless otherwise stated at checkout.
We may update pricing at any time. Price changes do not affect orders that have already been accepted, except where a pricing error has occurred.
8. Payment
Payment is collected at checkout using the payment methods made available on the website.
For pre-orders, payment may be collected before manufacturing begins in order to reserve your item and support the first production run.
By submitting payment information, you confirm that you are authorized to use the payment method provided.
9. Shipping and Delivery
Shipping is governed by our Shipping Policy.
Shipping timelines are estimates only and are not guaranteed unless expressly stated. Delivery may be affected by production timelines, carrier delays, customs processing, weather, labour disruptions, incorrect shipping information, or other circumstances outside our control.
Customers are responsible for providing accurate and complete shipping information. Field Works & Utility is not responsible for delays, failed delivery, or loss caused by incorrect or incomplete customer-provided shipping information.
Risk of loss may transfer to the customer once the order is delivered to the shipping address provided, unless otherwise required by law.
10. Returns and Refunds
Returns, refunds, pre-order cancellations, and warranty claims are governed by our Return and Refund Policy.
For pre-orders, customers may cancel at any time before production begins for a 100% refund, no questions asked.
For regular, non-pre-order purchases, we accept returns within 30 days of delivery for any reason, provided the item meets the return conditions stated in our Return and Refund Policy. Unless the return is due to a defect, fulfillment error, or other issue caused by Field Works & Utility, the customer is responsible for return shipping costs.
Shipping charges, if any, are non-refundable unless otherwise stated or required by law.
11. Warranty
Field Works & Utility products are covered by a 1-year warranty against defects in materials or workmanship under normal use.
This warranty applies to issues caused by defective construction, faulty materials, or manufacturing errors.
This warranty does not cover:

normal wear and tear;
-
fading;
-
staining;
-
abrasion;
-
cuts, punctures, or tears caused by use;
-
damage from improper care or washing;
-
damage from misuse, modification, neglect, or improper storage;
-
damage caused by tools, equipment, vehicles, fire, chemicals, animals, workplace hazards, or environmental exposure;
-
expected breakdown from heavy field use over time; or
-
damage resulting from use outside the product’s intended purpose.
Where a product qualifies under warranty, Field Works & Utility may, at its discretion, repair the product, replace the product, or issue a refund.
12. Normal Wear and Tear
Field products are built for demanding field use, but no soft goods are indestructible.
Normal wear and tear is not eligible for refund, return, or warranty replacement. This includes expected deterioration from repeated outdoor use, abrasion, dirt, weather, sweat, tools, brush, worksite contact, and other ordinary field conditions.
13. Product Use and Assumption of Risk
Customers are responsible for using Field products safely, appropriately, and in accordance with their workplace requirements.
Field Works & Utility is not responsible for injuries, losses, damage, or incidents arising from:

misuse of a product;

use in unsafe conditions;
-
failure to follow employer requirements;
-
failure to follow applicable laws, regulations, or safety standards;
-
modification of the product;
-
improper care or maintenance;
-
use of incompatible third-party accessories; or
-
reliance on the product as a substitute for required safety equipment or training.
14. Website Use
You agree not to use this website for any unlawful, harmful, fraudulent, or abusive purpose.
You may not:

interfere with the operation or security of the website;

attempt to gain unauthorized access to the website or related systems;

upload malicious code;
-
scrape, copy, or harvest website content without permission;

use the website to infringe the rights of Field Works & Utility or others;

submit false, misleading, or fraudulent information; or

Nothing on this website grants you any right, title, or interest in Field Works & Utility’s intellectual property.
16. Third-Party Services and Links
This website may use or link to third-party services, including payment processors, shipping providers, ecommerce platforms, analytics tools, and external websites.
Field Works & Utility is not responsible for third-party websites, services, policies, errors, outages, or content.
Your use of third-party services may be subject to their own terms and policies.
17. Limitation of Liability
To the fullest extent permitted by law, Field Works & Utility is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of the website or products.
This includes, but is not limited to:

workplace delays;

Nothing in these Terms limits liability that cannot legally be limited.
18. Disclaimer of Warranties
Except as expressly stated in our warranty policy, products and website services are provided on an “as available” basis.
Field Works & Utility does not guarantee that:

the website will be uninterrupted or error-free;

product images will exactly match final production items;

products will meet every customer’s specific workplace requirements;

estimated production or shipping timelines will be met; or
-
the website will be free from technical issues, viruses, or other harmful components.
19. Errors, Inaccuracies, and Availability
Occasionally, the website may contain errors, inaccuracies, or omissions related to product descriptions, pricing, availability, shipping, promotions, or other information.
We reserve the right to correct errors, update information, cancel orders, or refuse fulfillment where inaccurate information affects an order.
We may update, modify, suspend, or discontinue products at any time without notice.

The version posted on the website at the time of your order applies to that order. Continued use of the website after changes are posted means you accept the updated Terms.

These Terms of Service are governed by the laws of British Columbia and the laws of Canada applicable in British Columbia.
Any dispute relating to these Terms, the website, or products purchased from Field Works & Utility will be handled in accordance with the applicable laws of British Columbia, unless otherwise required by law.
